No, I don't think so. My understanding is that SCOTUS decisions are usually for very specific cases and don't apply universally to every state and entity, but they can -- and often are -- used as legal precedent in other similar cases that are subsequently brought by other states or entities. Perhaps Maddy can confirm?

My understanding is that the principle of the decision does apply everywhere, but individual cases have wrinkles that may make them different enough for a new decision to be needed.

What lawyer would ever advise Trump to do something so stupid? If the SCOTUS ever decided the question of whether a POTUS can do this I'd give it very little chance of them deciding in his favor. So then you basically have an admission of guilt in the form of the pardon to take to court.

There's an awesome graphic about 3/4 the way in that shows COVID (even with the inflated mortality figures) in perspective with annual mortality spikes from flu in recent decades, and other diseases going back a few centuries. Hint, COVID fails to impress. And it is a tiny fraction of the deaths from the 1918 flu - to which COVID is often compared.

I think it's disgusting how the media and government are playing on people's fears. I'm now predicting that COVID will be followed by a much larger and more severe pandemic: of COVID-triggered PTSD. That's more or less what long COVID is....take a person driven to the brink of hysteria by the COVID news coverage, they get sick (maybe with COVID, maybe just a cold), get a COVID test and it comes up positive. Bam, they're a statistic and they now are diagnosed with a disease they've been told is deadly. Is it any wonder some people report being fatigued months later?

Yes, U.S. Supreme Court decisions are considered the "law of the land," and they constitute direct authority (as opposed to persuasive authority) in every jurisdiction. They address a discrete set of facts, but the legal principles they enunciate apply equally to any subsequent case presenting the same issue.

It is always arguable whether a subsequent case involves facts and issues that are the same as one that came before it, since there is always a nuance that makes one case different from another. That's generally what lawyers argue about when a case is up on appeal. Attorney A argues that the Supreme Court's prior decision in Jones v. Brown is the more applicable precedent, while Attorney B argues that Smith v. Johnson is more apt.

Of course, if the U.S. Supreme Court is addressing an issue of state law (e.g., whether the state of Georgia complied with its own election laws), then the applicability of the resulting decision would obviously be limited to that particular state.

It has been around for decades. Unfortunately for those who speak like that I have an extreme bias against it so that when I'm listening to someone speak like that I cannot control myself from somewhat discounting their message. It is just too annoying and distracting to listen to. My emotions take over and it gets in the way of hearing the words.

I think that they must.

I know some remember Dave Winfield the Hall of Fame baseball player? After he retired he did some TV game broadcasting. He did the above as you described but it was so exaggerated that it came off as completely unnatural, which, of course, decreased his effectiveness.

What would be interesting is if this virus hit younger population instead of older population. I wonder if say 1-7 year olds had a 50 percent chance of dying...(or maybe 20 percent in line with those 75+ in present reality) but everyone else with fully developed immune systems was fine...how would that change peoples opinions here, if any.

You can go back 2 years (and many others) and see stories about the flu overwhelming hospitals, so while I was not following that sort of news in previous years, we are obviously all following now.

And I agree that it makes sense to run hospitals near capacity for economic reasons.

Just asking, are there any other reasons, other than it being a year long headline story, that COVID would cause more of a strain on hospitals than the flu? Like are more stringent isolation procedures used which use rooms or personnel up faster than the flu does?

So sure, we can blame the media for a lot of this hype, I am just wondering is there some gray area, where yeah, you can say the flu does the same thing to hospitals in previous years, but COVID makes it in whatever ways much harder to deal with?
